SECTION 1 - YOUR CONSUMER RIGHTS UNDER EU AND ITALIAN LAW
As a consumer in the European Union purchasing from Things Designs, you have important statutory rights that cannot be waived or limited:
1.1 RIGHT OF WITHDRAWAL (14-Day Cooling-Off Period)
You have the right to withdraw from your purchase within 14 days without giving any reason, in accordance with the EU Consumer Rights Directive (2011/83/EU) and the Italian Consumer Code (Codice del Consumo, Articles 52-59).
This right is explained in detail in Section 2.
1.2 LEGAL GUARANTEE OF CONFORMITY (2-Year Guarantee)
All products come with a legal guarantee of conformity for a minimum of 2 years from the date of delivery, in accordance with EU Directive 2019/771 and the Italian Consumer Code (Articles 128-135).
If products are defective or do not conform to their description, you have the right to:
- Free repair or replacement
- Price reduction or full refund (if repair/replacement is impossible or disproportionate)
This right is explained in detail in Section 7.
1.3 ADDITIONAL COMMERCIAL POLICY
In addition to your statutory rights, we offer a voluntary 30-day return policy for certain products (see Section 8).

SECTION 2 - 14-DAY RIGHT OF WITHDRAWAL (COOLING-OFF PERIOD)
2.1 OVERVIEW
You have the right to cancel your order and return products within 14 calendar days from the date you (or a third party you designate, other than the carrier) receive the goods, for any reason and without giving any justification.
This is a statutory right under EU and Italian consumer protection law and cannot be limited or waived.
2.2 WITHDRAWAL PERIOD
The 14-day withdrawal period begins on:
- The day you (or a third party designated by you, other than the carrier) physically receive the goods
- For multiple goods ordered in one order but delivered separately: the day you receive the last item
- For goods delivered in multiple lots or pieces: the day you receive the last lot or piece
- For regular delivery contracts over a period: the day you receive the first item
2.3 YOUR RIGHTS DURING THE WITHDRAWAL PERIOD
During the 14-day period, you may inspect and handle the products to establish their nature, characteristics, and functioning, in the same manner as you would be permitted to do in a physical store.
You must not use the products beyond what is necessary for such inspection. Products showing signs of use beyond reasonable inspection may result in a deduction from your refund to reflect diminished value.
2.4 CONSEQUENCES OF EXCESSIVE USE
You are only liable for diminished value resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.
We may deduct an appropriate amount from your refund if products show signs of excessive handling or use. This applies only to voluntary withdrawal returns, not to returns of defective products under the 2-year legal guarantee.

SECTION 3 - HOW TO EXERCISE YOUR RIGHT OF WITHDRAWAL
3.1 NOTIFICATION
To exercise your right of withdrawal, you must inform us of your decision to withdraw by making a clear statement. You can do this by:
METHOD 1: Using the Model Withdrawal Form (Section 4)

METHOD 2: Sending us a clear written statement
Email or write to us stating your decision to withdraw. Include:
- Your name and contact details
- Order number
- Date of order
- Date of delivery
- Description of products you wish to return
- Your decision to withdraw from the purchase

METHOD 3: Through your account (if applicable)
Log into your account and follow the return procedure.
3.2 DEADLINE FOR NOTIFICATION
You must notify us of your decision to withdraw before the expiry of the 14-day withdrawal period.
You meet the deadline if you send your notification before the 14-day period expires, even if we receive it after the period has ended.
3.3 ACKNOWLEDGMENT
We will send you an acknowledgment of receipt of your withdrawal notification by email without delay.
3.4 RETURNING THE GOODS
You must return the goods to us without undue delay and in any event no later than 14 calendar days from the day you notified us of your withdrawal.
You meet this deadline if you send back the goods before the 14-day period expires.

SECTION 5 - RETURN SHIPPING AND COSTS
5.1 FOR 14-DAY RIGHT OF WITHDRAWAL
Return Shipping Method:
You are responsible for arranging return shipping for withdrawal returns. You may use any shipping carrier of your choice.
Return Shipping Cost:
You bear the direct cost of returning the goods for voluntary withdrawal, unless:
- We have agreed to bear the cost
- We failed to inform you that you must bear the cost
- The goods are defective or non-conforming (see Section 7)
We estimate the maximum return shipping cost within the EU to be approximately €10-€25, depending on the carrier, speed, and package size. For returns from outside the EU, costs may be higher.
Recommendation:
- Use a tracked shipping service
- Keep proof of postage
- Adequately package the items to prevent damage during transit
- Consider insuring valuable items
5.2 FOR DEFECTIVE PRODUCTS (2-YEAR LEGAL GUARANTEE)
If you are returning products because they are defective or do not conform to the contract (under the 2-year legal guarantee - Section 7), you do NOT bear the cost of return.
We will either:
- Provide you with a prepaid return shipping label, OR
- Reimburse you for reasonable return shipping costs (keep your receipt)
Contact us at info@thingsdesigns.com to request a return label or return instructions for defective products.
5.3 ITEMS SENT WITHOUT PRIOR AUTHORIZATION
Please do not send items back to us without first notifying us of your withdrawal or requesting a return. Items sent back without prior authorization may not be accepted or may be significantly delayed in processing.

SECTION 6 - REFUND PROCESS AND TIMELINE
6.1 REFUND FOR 14-DAY RIGHT OF WITHDRAWAL
What we will refund:
We will reimburse all payments you made for the products, including:
- The product price
- The standard delivery cost you paid when ordering (if applicable)
We are NOT required to reimburse:
- Supplementary costs if you chose a more expensive delivery method than the standard delivery we offered (e.g., express shipping premium)
- The direct cost of returning the goods (unless we agreed to bear this cost or failed to inform you)
Refund timeline:
We will reimburse you without undue delay and no later than 14 calendar days from the day on which:
- We receive the goods back, OR
- You provide evidence that you have sent the goods back (e.g., proof of postage), whichever is earliest
Refund method:
We will refund you using the same payment method you used for the original transaction, unless you expressly agree to a different method. You will not incur any fees as a result of the refund.
6.2 WITHHOLDING REFUND UNTIL GOODS RECEIVED
We may withhold the refund until we have received the goods back or you have provided evidence of having sent the goods back, whichever is earliest.
However, we may NOT withhold the refund simply to penalize you for exercising your withdrawal right.
6.3 DIMINISHED VALUE DEDUCTION
We may deduct an appropriate amount from your refund if returned goods show signs of handling or use beyond what is necessary to establish their nature, characteristics, and functioning.
We will inform you of any deduction and you have the right to dispute it. This deduction does not apply to defective products returned under the 2-year legal guarantee.
6.4 INSPECTION AND PROCESSING
Upon receiving your return:
- We will inspect the goods promptly
- We will notify you by email whether your refund has been approved
- If approved, the refund will be processed within the legal timeframe (14 days)
- The refund will appear in your account subject to your payment provider's processing time
If there are any issues with your return, we will contact you before processing the refund.

SECTION 7 - 2-YEAR LEGAL GUARANTEE OF CONFORMITY (DEFECTIVE PRODUCTS)
7.1 YOUR RIGHTS UNDER THE LEGAL GUARANTEE
In accordance with EU law (Directive 2019/771) and the Italian Consumer Code (Articles 128-135), all products sold to consumers come with a legal guarantee of conformity for a minimum period of 2 years from the date of delivery.
Under this legal guarantee:
- Products must conform to the contract description
- Products must be fit for the purposes for which goods of the same type are normally used
- Products must possess the quality and performance normal in goods of the same type
7.2 WHAT IS COVERED
The legal guarantee covers:
- Manufacturing defects
- Products that do not match the description provided
- Products that are not fit for their normal purpose
- Products that lack promised features or functionality
- Products that do not have the quality and performance you could reasonably expect
7.3 HIERARCHY OF REMEDIES
If a product is defective or does not conform to the contract, you are entitled to remedies in the following order:
FIRST: Repair or Replacement (Your Choice)
You may choose between free repair or free replacement, unless your chosen remedy is:
- Impossible to provide
- Disproportionate compared to the other remedy
"Disproportionate" means the remedy would impose unreasonable costs on us compared to the alternative remedy, taking into account the value of goods if conforming, the significance of the lack of conformity, and whether the alternative remedy could be provided without significant inconvenience to you.
SECOND: Price Reduction or Refund
If repair or replacement is impossible, disproportionate, or we fail to provide repair or replacement within a reasonable time or without significant inconvenience to you, you may:
- Request a proportionate price reduction, OR
- Rescind the contract and receive a full refund
For minor defects, you are not entitled to rescind the contract and receive a full refund; a price reduction may be appropriate.
7.4 TIMEFRAME AND BURDEN OF PROOF
First 12 months (Presumption of defect):
For defects that become apparent within the first 12 months from delivery, it is presumed that the defect existed at the time of delivery, unless we prove otherwise or this presumption is incompatible with the nature of the goods or defect.
Months 13-24 (You must prove defect existed):
For defects that become apparent between 12 and 24 months after delivery, you may need to demonstrate that the defect existed at the time of delivery (e.g., through expert opinion).
7.5 REPORTING DEFECTS
You must inform us of any lack of conformity within 2 months from the date you discovered the defect.
We recommend reporting defects as soon as possible by contacting us at info@thingsdesigns.com with:
- Your order number
- Description of the defect or non-conformity
- Photos or videos showing the issue (if possible)
- Date when you discovered the issue
7.6 WHAT IS NOT COVERED
The legal guarantee does not cover:
- Defects arising from misuse, neglect, or failure to follow product safety instructions (see product documentation)
- Normal wear and tear
- Damage caused by accidents or improper handling
- Unauthorized modifications or repairs
- Use of products by persons for whom they are not intended (e.g., children when marked as not suitable for children)
- Defects you were specifically informed about before purchase
7.7 NO COST TO YOU
When you exercise your rights under the legal guarantee, you shall not incur any costs. This means:
- Repairs are free (including labor, parts, shipping)
- Replacements are free (including shipping)
- Return shipping for defective products is free (we provide label or reimburse costs)
7.8 PROCEDURE FOR DEFECTIVE PRODUCTS
To return a defective product under the legal guarantee:

Explain the defect and state whether you want repair or replacement.
Step 2: We will assess the issue
We may ask for photos, videos, or additional information to assess the defect.
Step 3: We will provide return instructions
If a return is necessary, we will provide a prepaid return shipping label or instructions.
Step 4: Return the product
Send the product back to us using the provided label or instructions.
Step 5: Repair, replacement, or refund
We will provide the agreed remedy within a reasonable time and without significant inconvenience to you, as required by law.

SECTION 8 - VOLUNTARY RETURNS (BEYOND 14 DAYS)
In addition to your statutory rights, we offer a voluntary 30-day return policy for unwanted items that are in perfect condition.
8.1 ELIGIBILITY
You may return products within 30 calendar days from the date of delivery if:
- You are beyond the 14-day statutory withdrawal period
- The product is not defective (defective products are covered by Section 7)
- You simply changed your mind or are not satisfied with the product
This is a voluntary commercial policy and does not affect your statutory rights.
8.2 CONDITIONS FOR VOLUNTARY RETURNS
To be eligible for a voluntary return beyond 14 days:
- The product must be unused, unworn, and in the same condition as received
- The product must have all original tags attached
- The product must be in its original packaging (where possible)
- You must have the receipt or proof of purchase
- You must contact us first to request authorization
8.3 PRODUCTS NOT ELIGIBLE FOR VOLUNTARY RETURNS
The following products cannot be returned under our voluntary 30-day policy (but are still covered by the 14-day statutory withdrawal right and 2-year legal guarantee):
- Products that have been used, worn, or installed
- Products with removed tags or labels
- Personalized or custom-made products
- Products made to your specifications
- Hygiene products that have been opened or unsealed (for health protection reasons)
- Digital downloads that have been downloaded (see Section 10)
8.4 PROCEDURE FOR VOLUNTARY RETURNS
Step 1: Contact us within 30 days of delivery

- Your order number
- Reason for return
- Description of items to return
Step 2: Wait for authorization
We will review your request and send you return authorization and instructions.
Step 3: Return the product
You must ship the product back to us within 14 days of receiving authorization.

Step 4: We inspect and process refund
Upon receiving your return, we will inspect it and process your refund if approved.
8.5 COSTS FOR VOLUNTARY RETURNS
For voluntary returns beyond 14 days:
- You are responsible for return shipping costs
- We will refund the product price only (not original shipping costs)
- No restocking fees apply
8.6 REFUSAL OF VOLUNTARY RETURNS
We reserve the right to refuse voluntary returns that:
- Do not meet the conditions in Section 8.2
- Were not authorized in advance
- Are received after the 30-day return period
- Show signs of use, wear, or damage
If we refuse a voluntary return, we will notify you and may return the items to you at your expense, or dispose of them with your consent.

SECTION 9 - EXCHANGES
9.1 EXCHANGES NOT OFFERED AS STANDARD
We do not offer direct exchanges. If you wish to exchange a product for a different size, color, or model:
Step 1: Return the original product
Follow the appropriate return procedure (Section 3 for 14-day withdrawal, Section 7 for defects, or Section 8 for voluntary returns).
Step 2: Place a new order
Once your return is processed and refunded, place a new order for the item you want.
This ensures you receive the correct item quickly without waiting for the return to be processed first.
9.2 EXCHANGES FOR DEFECTIVE PRODUCTS
If you received a defective product and want it replaced with the same product (not a different product), you may request a direct replacement under the 2-year legal guarantee (Section 7).
This is your statutory right and does not require a return and new purchase.
9.3 WRONG ITEM SENT
If we sent you the wrong item by mistake:

- We will provide a prepaid return label
- We will send you the correct item or process a refund, as appropriate
You will not bear any costs for our error.

SECTION 10 - PRODUCTS EXCLUDED FROM RIGHT OF WITHDRAWAL
Under EU law, certain types of products are excluded from the 14-day right of withdrawal. For Things Designs, this includes:
10.1 DIGITAL CONTENT
Digital downloads (such as digital art files, patterns, templates, or similar digital products) are excluded from the right of withdrawal IF:
- You gave your express consent to begin the download before the end of the 14-day withdrawal period, AND
- You acknowledged that you thereby lose your right of withdrawal, AND
- We provided you with confirmation of this agreement on a durable medium
Before downloading digital content, you will be asked to agree to these conditions. Once you consent and download begins, you cannot withdraw from the purchase.
If you have issues with digital downloads (files corrupted, wrong file, etc.), please contact us at info@thingsdesigns.com. We are happy to help resolve technical issues.
10.2 PERSONALIZED OR CUSTOM-MADE PRODUCTS
Products that are made to your specifications or clearly personalized (e.g., custom engraving, bespoke items made for you) are excluded from the 14-day right of withdrawal under EU law Article 16(c) of Directive 2011/83/EU.
These products will be clearly marked as "personalized" or "custom-made" in the product description.
10.3 SEALED HYGIENE PRODUCTS
Products sealed for health protection or hygiene reasons that have been unsealed after delivery cannot be returned under the 14-day right of withdrawal.
These products will be clearly marked in the product description if this exclusion applies.
10.4 IMPORTANT NOTE
These exclusions apply only to the 14-day right of withdrawal. They do NOT affect your rights under the 2-year legal guarantee of conformity (Section 7). If personalized or digital products are defective or do not conform to the contract, you still have the right to repair, replacement, price reduction, or refund.

SECTION 11 - CONDITION OF RETURNED PRODUCTS
11.1 INSPECTION AND TESTING
For returns under the 14-day right of withdrawal, you are entitled to inspect and test the products to establish their nature, characteristics, and functioning, as you would be permitted to do in a physical store.
11.2 CONDITION REQUIREMENTS
Products must not show signs of use beyond reasonable inspection and testing. Products should be returned free from stains, tears, excessive wear, scratches, or other damage not present upon delivery.
11.3 PACKAGING
We prefer that products are returned in their original packaging, but we understand that packaging may need to be opened for inspection.
You should:
- Keep all packaging materials during the 14-day period if possible
- Return products in protective packaging to prevent damage during shipping
- Include all accessories, manuals, and components
11.4 DEDUCTIONS FOR DIMINISHED VALUE
If returned products show excessive handling, use, or damage beyond reasonable inspection, we may deduct an appropriate amount from your refund to reflect the diminished value (for withdrawal returns only, not for defective products).
We will notify you of any proposed deduction before processing your refund, and you have the right to dispute it.

We aim to respond to inquiries within 1-2 business days. Return authorization requests are typically processed within 2-3 business days. Refunds are processed within 14 days of receiving your return, as required by EU law.

13.3 ONLINE DISPUTE RESOLUTION (ODR)
If you are a consumer in the European Union, you may access the European Commission's Online Dispute Resolution (ODR) platform at:

13.5 LEGAL ACTION
